Answers to Common Bankruptcy Questions
If you’re considering bankruptcy, it’s normal to have questions. Below are answers to some of the most common concerns we hear from clients.
Will filing for bankruptcy stop creditor calls?
Yes. Once your bankruptcy case is filed, an automatic stay goes into effect, which immediately stops most collection actions including creditor calls, lawsuits, wage garnishments, and foreclosures.
Will I lose my home or car if I file bankruptcy?
Not necessarily. Many clients are able to keep their home, vehicle, and other essential assets through available exemptions. Each situation is unique and depends on your finances and the type of bankruptcy filed.
What is the difference between Chapter 7 and Chapter 13?
Chapter 7 is designed to eliminate unsecured debt quickly, while Chapter 13 allows you to reorganize debts into an affordable repayment plan. Attorney Colpitts will help determine which option is best for your situation.
How long does the bankruptcy process take?
A Chapter 7 bankruptcy typically takes about 4–6 months to complete. Chapter 13 cases last between 3–5 years due to the repayment plan.
Will bankruptcy ruin my credit forever?
No. While bankruptcy does impact your credit initially, many clients begin rebuilding their credit shortly after discharge. Bankruptcy can often be the first step toward long-term financial recovery.
Is the consultation really free and confidential?
Yes. All initial consultations are completely free, confidential, and obligation-free. Our goal is to give you clear information so you can decide what’s best for you.
